What is TPD/TRPR?

The Tobacco Products Directive (TPD) (2014/40/EU) is the primary European Directive governing tobacco and related products, including e-cigarettes or Electronic Nicotine Delivery Systems (ENDS). 


Since the exit of the United Kingdom from the European Union (EU), TPD no longer applies to England, Scotland, and Wales where the UK Tobacco and Related Products Regulations (TRPR) is now effective. TPD does however still apply to products sold in Northern Ireland.

Both seek to:

 Regulate ingredients and emissions of tobacco & related products

 Regulate the labelling and packaging of tobacco & related products, ensuring they include the relevant health warnings

 Regulate cross-border & distance sales of tobacco & related products

 Ensure tobacco & related products are suitably notified

✓ Facilitate the smooth functioning of the internal market for tobacco & related products, and to place a high priority on protection of health, especially young people

What is required for a successful TPD/TRPR Notification?

In order to submit a successful TPD/TRPR Notification to the MHRA (for GB applications), and/or EU-CEG (for EU & NI applications) the following is required:


  • Emissions testing
  • Toxicological data for each ingredient
  • Compliant packaging
  • Natural Person/Responsible Person - Person or entity, located in the EU for TPD, and the UK for TRPR


Additionally, a Poison Centre Notification (PCN) is required for products entering the EU market.

  • What is TPD?

    TPD stands for the Tobacco Products Directive. TPD is the EU directive which covers requirements for tobacco and related products. These include e-cigarettes (vapes), combustible cigarettes, heated tobacco products, herbal products for smoking and more.

  • What is TPD compliance?

    A product is TPD compliant when it abides by all the relevant regulations set forth in TPD.

  • What testing is required for TPD?

    There are certain testing requirements set forth by TPD for electronic cigarettes. These include the analysis for certain carbonyls (Acrolein, acetaldehyde and formaldehyde), metals (Aluminium, chromium, Iron, Nickel, Tim) and nicotine dose consistency.

  • How are vapes notified in the EU?

    Vapes are notified in the EU using the EU Common Entry Gate (EU-CEG).

  • Is vaping legal in the EU?

    Vaping, or the use of electronic cigarettes by the public, is legal in the EU. There are country to country differences when it comes to whether selling flavoured vapes are banned but these are the concern of the seller and not the public.

  • Are disposable vapes legal in Europe?

    Disposable vapes are legal across Europe.

  • How are UK vapes regulated?

    Vapes are regulated by the Tobacco and Related Products Regulations (TRPR), and notified via the MHRA Portal.

  • How are vapes notified in the UK?

    Vapes are notified in the UK using the MHRA portal.

  • What testing is required for TRPR (UK)?

  • What is TPD in the UK?

    The UK vaping law (TRPR) is based off TPD and has much of the same requirements. 

  • Is vaping legal in UK?

    Vaping is currently legal in the UK. This includes disposable e-cigarettes, pod systems and open device systems.

  • What is the UK vape puff count limit?

    There currently is no legislation regarding the maximum puff count of a vape device. The puff count of a device largely depends on the tank size of the device which has a limit of 2ml.
