The Tobacco Products Directive (TPD) (2014/40/EU) is the primary European Directive governing tobacco and related products, including e-cigarettes or Electronic Nicotine Delivery Systems (ENDS).
Since the exit of the United Kingdom from the European Union (EU), TPD no longer applies to England, Scotland, and Wales where the UK Tobacco and Related Products Regulations (TRPR) is now effective. TPD does however still apply to products sold in Northern Ireland.
Both seek to:
✓ Regulate ingredients and emissions of tobacco & related products
✓ Regulate the labelling and packaging of tobacco & related products, ensuring they include the relevant health warnings
✓ Regulate cross-border & distance sales of tobacco & related products
✓ Ensure tobacco & related products are suitably notified
✓ Facilitate the smooth functioning of the internal market for tobacco & related products, and to place a high priority on protection of health, especially young people
In order to submit a successful TPD/TRPR Notification to the MHRA (for GB applications), and/or EU-CEG (for EU & NI applications) the following is required:
Additionally, a Poison Centre Notification (PCN) is required for products entering the EU market.
