What are the FDA regulations for CBD products?

We have written about CBD regulations before, however it has always been in relation to the required regulations in Europe and the UK. But what about the USA? Like e-cigarettes, CBD products fall under FDA regulations, so they set the rules to protect public health and ensure that products sold in the US are safe for consumers.

The current FDA CBD regulations

At present, individual states may have their own CBD regulations in place, for example CBD is legal in California but not Iowa or Idaho.

FDA state on their website that they recognize the “potential opportunities that cannabis or cannabis-derived compounds may offer and acknowledge the significant interest in these possibilities.”

FDA have indicated that they are working on more robust regulation in the future

Over the past few months, FDA have indicated that they are working on developing regulations specifically for CBD products, with Dr Amy Abernathy, the leader of FDA’s CBD Working Group, stating that “the CBD working group is exploring how additional research can be quickly performed and do so efficiently in order to to address these critical questions of safety and effectiveness of CBD.”

FDA have also issued guidance to encourage clinical research around cannabis-derived products and hosted a conference on the differences in effect of CBD and other cannabinoids on sex and gender.

This increase in CBD-related content suggests that this is an area which FDA are paying attention to at the moment.
