What you need to know about EU Novel Food authorisation as a CBD manufacturer

As of January 2019, CBD products are now regulated as Novel Food Products in the EU, meaning that CBD manufacturers must submit a Novel Food Application for each of their products by 31st March 2021 in order to place their products on the market legally.

Here’s what you need to know about Novel Foods and how to get your products authorised in the European Union.

What are “novel foods”?

Novel foods are defined by the Food Standards Agency as “ foods which have not been widely consumed by people in the UK or EU before May 1997. ” This includes foods which are traditional in another part of the world but are new to being widely consumed in the EU, new foods and ingredients and foods which have been produced using new processes.

Before they can be marketed in the EU, novel foods must be assessed and authorised through a Novel Food application in order to ensure that they are safe for public consumption.

Why is CBD a novel food?

While CBD is not a new ingredient, it wasn’t consumed on a large scale until recent years. As CBD products have gained popularity, the European Commission have had to take steps in order to ensure that the CBD products on the market are safe for use and deliver what they say they will.

While cannabis seeds and seed oil products are still considered “traditional”, products containing cannabidiol are now considered to be novel foods and are required to submit a novel food application by March 31, 2021 in order to be marketed in the EU.

How do I get my CBD product authorised in the EU?

To market your CBD products legally in the EU, you must submit a novel food application to the European Commission and gain authorisation. The application includes a dossier of information including  a stability study, toxicological review, CMC data and risk assessment.
